1. Agreement to Terms

By accessing or using Translate Silence (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and The Data Adapter ("we," "us," or "our").

2. Description of Service

Translate Silence is a behavioral observation platform that enables users to:

  • Log and document behavioral observations about yourself, dependents, students, household members, or supported individuals where you have appropriate authority or consent
  • Receive AI-generated analysis, tags, and follow-up questions
  • Generate reports for schools, clinicians, or family members
  • Contribute anonymized data to research datasets (if opted in)
  • Access behavioral pattern insights and visualizations

NOT MEDICAL ADVICE: The Platform is NOT a diagnostic tool, medical device, or substitute for professional medical advice, diagnosis, or treatment. All observations, AI analyses, and reports are for informational and documentation purposes only.

3. User Accounts and Registration

To use the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities that occur under your account

You must be at least 18 years old or have parental/guardian consent to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.

4. User Content and Responsibilities

Ownership: You retain ownership of all content you submit to the Platform, including observations, supported profiles, follow-up responses, voice notes, and documents.

License to Us: By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display your content solely for the purpose of providing Platform services.

Research License: If you opt in to research data use (privacy level: "research_eligible"), you grant us an additional license to anonymize and include your content in aggregated research datasets shared with researchers, institutions, and partners.

Prohibited Content: You agree NOT to submit content that:

  • Contains personal information about any individual unless you have the legal right, consent, or appropriate authority to provide it
  • Is defamatory, harassing, threatening, or abusive
  • Violates third-party privacy rights or intellectual property
  • Contains images, videos, or sensitive records you do not have authority to upload or share
  • Is false, misleading, or fraudulent

Accuracy: You are responsible for the accuracy and truthfulness of your observations. Do not fabricate or exaggerate behavioral descriptions.

5. AI-Generated Content

The Platform uses artificial intelligence to:

  • Generate behavioral, sensory, emotional, and environmental tags
  • Provide structured summaries of observations
  • Identify patterns across observations
  • Generate follow-up questions
  • Create reports and insights

NO GUARANTEES: AI-generated content is provided "as is" without warranties of accuracy, completeness, or fitness for any purpose. AI analysis may contain errors, biases, or inaccuracies.

NOT PROFESSIONAL ADVICE: AI-generated insights do not constitute professional medical, psychological, educational, or legal advice. Always consult qualified professionals for important decisions.

The AI disclosure below explains these limitations, data storage practices, and your responsibility to review AI-generated content before using or sharing it.

AI Disclosure and Data Storage

Critical disclosure: Translate Silence uses artificial intelligence to organize observations, suggest tags, generate follow-up questions, identify account-local patterns, and create reports. AI-generated content is probabilistic and may be incomplete, biased, or incorrect.

Human review required: Always review AI-generated tags, summaries, insights, and reports before sharing them with schools, clinicians, caregivers, or support teams. AI output is not medical, psychological, educational, legal, or therapeutic advice.

Data storage: Observations, supported profiles, voice notes, documents, and AI-generated content are stored in secure cloud databases. AI processing may occur through third-party AI providers that process data only to provide platform services.

Context limits: AI only uses what you provide. It cannot know body language, tone, history, baseline behavior, document contents, or environment details unless you explicitly add that information.

Your control: You can edit or delete observations, tags, context, documents, and AI-generated content through the platform. Research sharing only occurs if you opt in.

6. Payment and Donations

Voluntary Contributions: The Platform accepts voluntary donations to fund research infrastructure. Donations are not required to use core Platform features.

No Refunds: Donations are final and non-refundable, except as required by law.

Founding Contributor Certificates: Donors may receive Founding Contributor certificates recognizing their support. These certificates are honorary and do not confer financial or governance rights.

Payment Processing: Payments are processed by Stripe, a third-party payment processor. By making a donation, you agree to Stripe's terms of service.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Platform will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of any content or information
  • Warranties that the Platform will meet your specific requirements or expectations

No advice or information, whether oral or written, obtained from us shall create any warranty not expressly stated herein.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • WE SHALL NOT BE LIABLE FOR DAMAGES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE PLATFORM; (B) UNAUTHORIZED ACCESS TO YOUR ACCOUNT; (C) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE PLATFORM; (D) ERRORS, BUGS, OR INACCURACIES IN PLATFORM CONTENT; (E) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM PLATFORM USE
  • OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR $100 WHICHEVER IS GREATER

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless The Data Adapter, its officers, directors, employees, contractors, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your submission of user content

10. Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, with or without cause, and with or without notice.

Upon termination, your right to use the Platform will immediately cease. You may request deletion of your data by contacting support@thedataadapter.com.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email and/or prominent platform notice at least 30 days before the changes take effect.

Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law in the jurisdiction where The Data Adapter is legally established, without regard to conflict of law principles, unless consumer protection law requires otherwise.

Dispute Resolution: Before filing a claim, you agree to contact us and attempt to resolve the dispute informally. Where permitted by law, disputes may be resolved through binding arbitration or another lawful dispute resolution process designated by The Data Adapter. Nothing in these Terms limits rights that cannot be waived under applicable law.

Class Action Waiver: You agree to resolve any dispute in your individual capacity only and waive any right to participate in class actions or representative proceedings.

Exception: Notwithstanding the above, either party may seek injunctive relief in court to protect intellectual property or confidential information.

13. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and the AI disclosure included above, constitute the entire agreement between you and us regarding the Platform.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of those rights.

Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control (natural disasters, pandemics, war, terrorism, internet disruptions, etc.).
